AudioDigest 利用規約 (Terms of Service)

第1条（総則および同意）
本利用規約（以下「本規約」）は、pyonkai-technology（以下「当社」）が提供するアプリケーション「AudioDigest」および関連サービス（以下「本サービス」）の利用条件を定めます。ユーザーは本サービスを利用することで、本規約およびプライバシーポリシーに同意したものとみなされます。
第2条（サービスの目的および定義）
本サービスは、ユーザーが指定した公開WebページのURLまたは検索トピックからテキスト情報を抽出し、人工知能（AI）を用いて要約および音声台本を生成し、テキスト読み上げ技術（TTS）により音声として再生・聴取を支援するパーソナル情報インプットツール（中立的なユーザーエージェントツール）です。
第3条（著作権および私的使用の限定）
対象コンテンツの著作権は原権利者に帰属します。本サービスは、著作権法第30条（私的使用のための複製）の範囲内でのみ利用されることを前提としており、生成コンテンツの無断公衆送信・商用再配信を禁止します。また、著作権法第32条（引用）に基づき、元記事のタイトル、ドメイン名、元のWebページへのリンクを常時明示します。
第4条（AI出力に関する非保証および免責事項）
AI出力に関する重要免責: 要約および音声台本は生成AIにより自動生成されます。事実誤認（ハルシネーション）が生じる可能性があるため、正確性・完全性を保証するものではありません。重大な判断を行う際は、必ず元記事の一次情報を直接ご確認ください。
第5条（有料サブスクリプションおよび課金）
本サービスは無料プラン（Free）および有料定期購入プラン（Pro）を提供します：
- 月額プラン: ¥980 / 月（税込）（US: $6.99 / 月）
- 年額プラン: ¥7,800 / 年（税込）（US: $54.99 / 年）※7日間の無料トライアルが付与される場合があります。
自動更新: 請求期間終了の少なくとも24時間前までに解約しない限り、定期購入は同期間・同金額で自動的に更新されます。請求期間終了前の24時間以内にApple IDまたはGoogle アカウントへ請求が行われます。
解約手順: 各プラットフォームの公式設定（iOSの「設定」＞Apple ID＞「サブスクリプション」、またはGoogle Playの「お支払いと定期購入」＞「定期購入」）からいつでも解約可能です。アプリをアンインストールしても解約されません。
第6条（BYOK: ユーザーAPIキーの保護）
ユーザーが自身のGemini APIキーを設定（BYOK）する場合、キーは端末内の安全な暗号化領域（Keystore/Keychain）にのみ保存され、当社のサーバーには一切送信・保存されません。
第7条（禁止事項）
有料会員ペイウォール記事の不正迂回、過度な負荷をかけるDDoS攻撃、リバースエンジニアリング、要約データの大量スクレイピングによる競合サービスの構築等を禁止します。
第8条（損害賠償の制限および準拠法）
当社の賠償責任は、直近12ヶ月間にユーザーが現実に支払ったPro利用料金の総額を上限とします。本規約は日本法に準拠し、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the AudioDigest mobile application and related web and API services provided by pyonkai-technology ("we", "us", or "our"). By installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy.
2. Description of the Service
AudioDigest is a personal assistive tool (neutral user-agent) that extracts clean text from user-provided public web URLs, generates concise summaries and scripts using Artificial Intelligence (AI), and synthesizes voice playback (Text-to-Speech) for personal, hands-free audio consumption.
3. Intellectual Property & Personal Use Limitation
All copyrights and intellectual property rights in third-party web content remain with their original authors and publishers. The Service is provided solely for your personal, non-commercial educational and informational use (under Article 30 of the Japanese Copyright Act and Fair Use doctrines). We strictly adhere to citation principles: original article titles, publisher domains, and direct source links are conspicuously displayed for all summaries.
4. AI Output Disclaimers & Accuracy
AI Disclaimer: Summaries and audio scripts are generated automatically by large language models. While we strive for high precision, AI models may occasionally produce inaccuracies or "hallucinations". We make no warranties regarding accuracy, completeness, or fitness for a particular purpose. You should always verify critical information against the original primary source.
5. Auto-Renewable Subscriptions & In-App Purchases
AudioDigest offers a Free tier and an auto-renewing Pro Subscription:
- Monthly Plan: ¥980 / month (or local equivalent in USD $6.99)
- Annual Plan: ¥7,800 / year (or local equivalent in USD $54.99), which may include a 7-day free trial.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can manage or cancel your subscription anytime via your device settings (iOS Settings > Apple ID > Subscriptions, or Google Play Store > Payments & subscriptions). Uninstalling the app does not cancel your subscription.
6. Bring Your Own Key (BYOK)
If you configure your personal Gemini API key, the key is stored strictly within your device's hardware-encrypted storage (Android Keystore / iOS Keychain) and is NEVER transmitted to or stored on our servers.
7. Prohibited Conduct
You agree not to: (a) bypass or attempt to circumvent paywalls or technical protection measures; (b) overload or disrupt our infrastructure or APIs; (c) reverse engineer the application; or (d) scrape generated content to create competing services.
8. Limitation of Liability & Governing Law
To the fullest extent permitted by law, pyonkai-technology's aggregate liability shall not exceed the total amount actually paid by you for the Pro subscription in the 12 months preceding the claim. These Terms are governed by the laws of Japan, with exclusive jurisdiction in the Tokyo District Court.
